Fall River County Minutes Of September 4, 2018

The Fall River Board of County Commissioners met in regular session on September 4, 2018 in the courtroom on the second floor of the Courthouse. Present: Ann Abbott, Joe Allen, Joe Falkenburg, Paul Nabholz, Deb Russell and Sue Ganje, Auditor.

The Pledge of Allegiance was stated, and the meeting called to order at 9:00 a.m.

The agenda was reviewed for conflicts; none were noted. All motions recorded in these minutes were passed by unanimous vote, unless otherwise stated.

Motion made by Russell, seconded by Nabholz, to approve the agenda as written.

Motion made by Nabholz, seconded by Russell, to approve the minutes of August 14, 2018.

No minutes for August 21, 2018 were presented.

Motion made by Russell, seconded by Abbott, to amend the August 7, 2018 minutes to reflect proper spelling for Melisa Hedman, hired in the Director of Equalization office.

Motion made by Russell, seconded by Abbott to set the contingency transfers and supplement hearing for September 18, 2018 at 10:30 a.m.

Steve Yenulonis, Deputy Sheriff, met with the board. Discussion was held on a possible move out of the county, while still employed by the county. Yenulonis stated that his new home location would still provide a good response time. Frank Kistler, Deputy Sheriff, currently resides in the City of Edgemont, which fulfills the requirement of the Edgemont Law Enforcement contract. The board consented that it would be okay.

Frank Maynard, Emergency Management, met with the board to request a temporary part time person to complete the Comprehensive Resource Management and Credentialing System (CRMCS). Maynard estimated it would take 80 hours. No action was taken at this time.

Motion made by Russell, seconded by Allen, to approve the 2019 SLA agreement and authorize the chairman to sign.

Maynard advised the board of a post fire grant. Motion made by Nabholz, seconded by Abbott, to authorize Maynard to apply for the Hazard Mitigation Grant Program-Post Fire (HMGP-PF) grant. 

Motion made by Abbott, seconded by Russell, to approve travel for Maynard to attend the Safety Benefits training in Pierre, November 6 and November 7, 2018.

Maynard informed the board of the annual full-scale exercise for responders that was held at the State Veteran’s Home, and of the Wall Canyon fire.

John McBride, Andersen Engineers, met with the board. Motion made by Russell, seconded by Nabholz to approve the following plat, with Lots 4 and 5, rather than Lots 1 and 2 as listed on the agenda:

Fall River County Resolution #2018-16

A plat of Lots 4 and 5 of Green Valley Subdivision in part of the E1/2NW1/4 of Section 20, T7S, R5E, BHM, Fall River County, South Dakota

WHEREAS, there has been presented to the County Commissioners of Fall River County, South Dakota, the within plat of the above described lands, and it appearing to this Board that the system of streets conforms to the system of streets of existing plats and section lines of the county; adequate provision is made for access to adjacent unplatted lands by public dedication or section line when physically accessible; all provisions of the county subdivision regulations have been complied with; all taxes and special assessments upon the property have been fully paid; and the plat and survey have been lawfully executed; now and therefore,

BE IT RESOLVED that said plat is hereby approved in all respects.

Falkenburg initiated discussion on the blocking of the railroad crossing in Edgemont. A number at BNSF railroad that can be called for help or to report a blocked crossing is 763-782-3212. The county will continue to be highly involved in this issue. Motion made by Russell, seconded by Abbott, to authorize Brian Ahrendt, Deputy State’s Attorney, to draft and send letters to all necessary people on the issue of blocking the railroad crossing.

Discussion was held on if the county would have any luck in opposing the permit to inject production water by Peter Roosevelt. Ahrendt will present his opinion at the next meeting.

Motion made by Nabholz, seconded by Allen to authorize sending a letter to the Bureau of Indian Affairs to oppose placing the Flint Hills property into exempt status for the Oglala Sioux Tribe. Doing so would increase property taxes for other Fall River County taxpayers and give that property owner an unfair advantage in agriculture production. Also, concerns were raised for loss of revenue for possible law enforcement and fire protection.

Randy Seiler, Highway Superintendent, met with the board. Motion made by Nabholz, seconded by Abbott, to approve the August 2018 fuel used or work performed to reimburse the highway department as follows: Weed & Pest for $792.60; Sheriff’s Department for $2,851.32; Building for $53.56; Emergency Management for $127.09; Director of Equalization for $153.37 and Fire fund for the Vineyard fire, $1,893.41. 

Discussion was held on the 2018 5-year plan and updated costs for the 178’ Chilson Bridge. Current estimates on the bridge are: #1 - Single span steele girder, $2,252,081.23; #2 – 2 span Prestressed concrete girder, $1,831,546.23 and #3 – 3 span Prestressed concrete girder, $2,170,321.23. Seiler stated the bridge should be completed in 2020.

Discussion was held on road graders the highway department currently has; the next purchase will be in May of 2020.

Public comment was heard from Jim Angell. Angell had concerns about land for sale in the Rocky Ford area.

Bob Evans, Sheriff, met with the board. Motion made by Russell, seconded by Allen, to approve hiring Nyna Nygard, 24/7 at $13.00 per hour, effective August 30, 2018; Brandon Luther, jailer, $12.50 per hour, effective September 10, 2018, as per union contract and David Pokorski, jailer, $12.50 per hour, effective September 18, 2018.

A brief discussion was held about the Edgemont Law Enforcement Contract.

Public comment was heard from Paul Nabholz who advised the board of a section line easement issue on Highway 71.

Kelli Rhoe, Treasurer, and Debbie Suter met with the board. Motion made by Nabholz, seconded by Allen, to deny the request for a delinquent tax agreement due to request being made after the serving of the tax deed papers.

Sue Ganje, Auditor, met with the board. Motion made by Russell, seconded by Allen, to approve the discretionary formula for Black Hills Power, pay 2019 in the amount of $677,119.00 for the Edgemont City Sub-Station #12 (year one) and $223,246.00 for Hot Springs Shop building, (year 4). 

Motion made by Abbott, seconded by Russell to approve the operating transfer from the General fund to the Emergency Management fund in the amount of $61,655.00 and to the 911 fund in the amount of $197,000.00, as budgeted.

Ganje and the board reviewed the current budget year to date expenses.

Lyle Jensen, Building Supervisor, met with the board. Motion made by Russell, seconded by Abbott, to approve travel for the Safety Benefits Training in Pierre, November 6 and November 7, 2018.

The 2019 Provisional Budget hearing was held as advertised. The board agreed they will not increase taxes this year for growth and cpi. 

Applicants for county assistance met with the board. Motion made by Russell, seconded by Allen to approve paying CP 2018-5 in the amount of $74.70. With Nabholz voting no, all others voting yes, motion carries.

Motion made by Allen, seconded by Russell, to enter into executive session as per SDCL 1-25-2 for legal purposes at 11:42 a.m.
