City Owned, Retail Off-Sale Liquor License
NOTICE IS HEREBY GIVEN that the City Council of the City of Hot Springs, South Dakota, is accepting sealed written bids at City Hall, 303 North River, Hot Springs, South Dakota 57747 until 5:00 p.m. Monday, March 6, 2023, for the lease of one (1) City owned, retail off-sale liquor license (PL). Sealed bids will be opened at the regular meeting of the City Council on March 6, 2023 at 7:15 p.m.
The City determines the minimum value of the vacant license to be $50,000 dollars, based on previous liquor license sales. No bids will be considered below the established minimum. All bidders are required to submit the following information/documentation along with the offered price;
• Business Plan, including proposed location
• Completed SD Uniform Alcoholic Beverage License Application -https://dor.sd.gov/media/5xnpi3pr/uniform-alcoholic-beverage-license-application.pdf
• Acknowledgement of intent and ability to meet all licensing standards established in SDCL §35-2 https://sdlegislature.gov/Statutes/Codified_Laws/2058858
Sealed bids must be plainly marked “BID - City owned off-sale liquor license” to identify its contents. No bid shall be withdrawn after the filing time without written consent of the Hot Springs City Council for a period of thirty (30) days.
The successful bidder is subject to the statutory licensing terms regarding notice, hearing and all license requirements. Prior to the issuance, a SD Business License, SD Sales Tax License and proof of liquor liability insurance must be provided to the City. The successful bidder will enter into an operating agreement with the City, copies of said agreement are available upon request.
The City Council of the City of Hot Springs, South Dakota, reserves the right to reject any and all bids, or to waive any formalities or technicalities in bidding, and to accept the bid that is to the advantage of, and in the best interest of, the City of Hot Springs. If two or more sealed bids are identical in price, and are the high bid, the City Council, through the Mayor, shall award by auction to one of the identical high bidders. In the event that no valid applications/bids are received, the on-sale liquor license shall become available on a first-come, first served basis, subject to the established minimum value being offered and all other statutory and municipal licensing standards.
