Fall River County Unapproved Minutes of July 7, 2022
The Fall River Board of County Commissioners met in regular session on July 7, 2022. Present: Joe Allen, Les Cope, Joe Falkenburg, Deb Russell and Sue Ganje, Auditor. Heath Greenough was absent.
The Pledge of Allegiance was given, and the meeting called to order at 9:00 a.m.
The agenda was reviewed for conflicts; none were noted. All motions recorded in these minutes were passed by unanimous vote, unless otherwise stated. Motion made by Russell, seconded by Allen, to approve the agenda with the addition of changing the WIC dates to read from June 1, 2022 to May 31, 2023.
Motion made by Russell, seconded by Allen, to amend the January 6, 2022 minutes to reflect designating $206,500.00 to the Argentine and Chilson Bridge projects for the General Fund Surplus Analysis, rather than $216,000.00.
Motion made by Russell, seconded by Allen, to set the 2023 distribution of PILT monies hearing on July 21, 2022 at 9:30 a.m.
Motion made by Russell, seconded by Cope, to approve the WIC Contract between the State of South Dakota Department of Health and Fall River County for the period of June 1, 2022 to May 31, 2023.
Motion made by Cope, seconded by Russell, to approve the pay raise for Paula Heimgartner, Dispatch, 2080 hours, $16.50 to $17.50 per hour, effective July 3, 2022, as per union contract.
Motion made by Russell, seconded by Allen, to approve Longevity pay for Casey Raskiewicz, $25.00 per month, effective June payroll, as per union contract.
Motion made by Cope, seconded by Russell, to surplus to junk a Dell tower, #01970, and monitor #02250, from the Treasurer’s office.
The Board received notification of the Empower Coalition of the Southern Hills’ 50/50 raffle for the Toys for Kids program.
Motion made by Russell, seconded by Allen, to approve CP 2022 – 04, as applicant is below the poverty guidelines.
Frank Maynard, Emergency Management, met with the Board. Motion made by Russell, seconded by Allen, to approve the L.E.M.P.G. 3rd quarter single Signature Sheet, and authorize the chairman to sign.
Maynard and Sheriff Bob Evans discussed the burn ban and the possible need to re-visit the burn ban resolution to eliminate confusion in the future on what weather website to refer to for fire danger, regarding fireworks.
Sheriff Evans reported that there were 7 males and 5 females in the Fall River County Jail, with 3 inmates in the Pennington County Jail; he will also bring back approval for Deputy Belt to attend Active Shooter training. Commissioner Russell asked Sheriff Evans to contact the schools, or Resource Officer, with the updates on training as it may be beneficial to them.
Maynard stated that the Annual Rally Meeting will be held on July 13, 2022 at Camp Rapid, discussed the higher fire danger in Fall River County and reported fires and incidents.
Erin McGlumphy, Extension, met with the Board. Motion made by Russell, seconded by Allen, to approve hiring Amy Leal, $14.00 per hour, effective July 11, 2022, as per union contract.
Stacey Martin, GIS, met with the Board. Motion made by Cope, seconded by Russell, to approve the Newman Sign quote for sign replacement order (2nd half) in the amount of $2,905.37.
Motion made by Cope, seconded by Allen, to approve hiring Jon Lovett, assist with sign replacement, $14.05 per hour, up to 40 hours maximum.
Martin spoke of the possibility of having an ordinance for novelty road signs, along with a reminder on the road naming policy; Martin will bring it back to the Board at the next meeting.
Martin also presented her 2023 budgets for GIS and 911 sign replacement.
Melody Engebretson, Register of Deeds, presented her 2023 budget to the Board.
Teresa Pullen, Treasurer, met with the Board. Motion made by Cope, seconded by Allen, to allow Pullen to donate Historical Military items at her discretion.
Pullen advised she is looking at Treasury bills for higher interest investments.
The supplement transfers and contingency hearings were bradheld as advertised.Motion made by Allen, seconded by Russell, to approve the following resolution:

NOW THEREFORE BE IT RESOLVED by the Board of County Commissioners to adopt the Supplemental Budget #1 and Contingency Transfer #1 for 2022.

Randy Seiler, Highway Superintendent presented his 2023 budget for review.
Seiler updated the Board that the Oral Crossing is scheduled for maintenance starting July 26, 2022 and the crew predicted that the crossing would be closed completely for a couple of days. The Board requested to see if there could be a temporary bypass be put in to avoid closing the crossing; Seiler will know more on July 18, 2022. The 2” Crusher fines have been installed at Shep’s Canyon and the Base 1 project will begin on July 28, 2022. The company will be donating an additional 2 totes to top dress the road (approximately $14,000.00) to finish. Mag water can be applied after 72 hours. Discussion was held on the merits of mag water and better possible solutions.
Discussion was held on approaches around the County being put in; Seiler wondered if planning and zoning may be a solution to control building in the County.
Brad Wilson, SD Workman’s Comp (via phone) and Gary Drewes met with the Board to explain the Revised Intergovernmental Contract Coverage for the SDML Workers’ Compensation Fund, to allow for foreign travel. It is rare that a county has someone involved in foreign travel. The Board will decide at the next meeting.

Public comment was heard from Jim Angell on the June Primary Recount and loss of votes due to a ballot stamp issue. Additional comments were heard from Sheriff Evans about the security guard resigning; he will talk to the judges to see if still needed and/or if the court system will pay for a portion of the costs if a new guard is hired.

Commissioner Cope spoke of 21 different assessments categories in the proposed Black Hills Forest Plan draft, noting that the plan for the National Grasslands will be in 2023.Nina Steinmetz, Weed and Pest, is reviewing the portion of the plan that includes insects, disease and soils for possible comments. Frank Maynard, Emergency Management, is doing the same for the fire and fuels portion of the plan. JT Rickenbach is representing the SD Stockgrowers Association. The Board asked that Cope keep them updated.
Commissioner Falkenburg spoke of an article in the Tri-State Livestock News regarding the sale of 35,000 acres to the Bureau of Land Management in Wyoming. Governor Gordon of Wyoming noted irregularities in the purchase procedure that is set by the Federal Land Policy and Management Act of 1976 which includes a notification process. Falkenburg stated it is wrong for the way this sale occurred, which the BLM called it an oversight. The Code of the West is supposed to protect Fall River County as the Forest Service is supposed to keep the County informed on activities, which would include issues like this.
Commissioner Allen would like to move his portion to executive session.
Sue Ganje, Auditor, presented her 2023 budgets for the Auditor’s Office and Elections to the Board.
Discussion was held on how to spend on American Rescue Plan Act (ARPA) funds. Possibilities include salaries, roads and the jail at this time. Comments were made about the possibility of a chip seal on Shep’s Canyon Road, rather than mag water; Seiler will do further research.
Motion made by Allen, seconded by Russell, to enter Executive session as per SDCL 1-25-2 (1) for personnel purposes, as per SDCL 1-25-2 (3) for legal purposes and as per SDCL 1-25-2(4) for negotiation purposes at 10:27 a.m.
The Board came out of executive session at 10:55 a.m.
