Fall River County Approved Minutes of December 30, 2021
The Fall River Board of County Commissioners met in special session on December 30, 2021. Present: Joe Allen, Les Cope, Joe Falkenburg, Heath Greenough, Deb Russell and Bobbie Janis, Auditor Administrative Assistant.
The Commissioners did their tour of the County Jail at 8:40 a.m. Items discussed were as follows: The need for a quote or estimate for complete replacement of the existing plumbing or at least replacement of the dilapidated existing plumbing and potential use of ARPA funds to cover the cost; beginning January 7, 2022 there is a requirement of having two 911 Dispatchers on duty at all times, with discussion of potentially raising the pay grade; the stairs that lead from the Jail facility to the basement of the courthouse need to be assessed for the use of jailers accompanying prisoners going to court as they are quite narrow and seem unsafe for shackled individuals to try to go up or down and are possibly not at a level to meet building codes.
The Pledge of Allegiance was given, and the meeting called to order at 9:00 a.m.
The agenda was reviewed for conflicts; none were noted. All motions recorded in these minutes were passed by unanimous vote, unless otherwise stated. Motion made by Russell, seconded by Allen to approve the agenda as written with an amendment to add a motion to reschedule the hearing for the transfer of the following licenses; Retail (on-off sale) malt beverage and SD Wine License; Package (off sale) Liquor; Retail (on sale) Liquor from Bob Azarski DBA Angostura Den, Inc. to Billie Besco from January 6, 2022 at 9:25 a.m. to January 20, 2022 at 9:30 a.m.

Motion made by Cope, seconded by Russell, to clarify the November 4, 2021 Essential employee designation was to be per COVID-19 ARPA purposes and does not affect the Emergency Personnel Essential designation per Union contract.
No applications for county assistance or death expenses were presented to the Board.
Sheriff Evans met with the Board. Motion made by Russell, seconded by Allen, to approve travel for Isnalawica Belt to attend the ARIDE training in Deadwood, SD January 12-13, 2022. There was discussion on the type of training and the need for an agenda to be turned in at the Auditor’s office for clarification on reimbursement of meals.
Evans also noted that there were 17 male prisoners and 3 female prisoners in the Fall River County Jail, with 1 male in the Pennington County Jail, for a total of 21 inmates. He announced that Deputy Kyle Maciejewski’s last day will by December 31, 2021 as he has accepted a position as a Highway Patrol Officer. The Sheriff’s department is advertising to fill the position.
Lillian Heidebrink, Director of Equalization, and GIS Coordinator, Stacey Martin met with the Board to present and discuss their recommendation of the math methodology for Ag soil adjustments. The two recommended ratios were 70% or 75% of value. Motion made by Cope, seconded by Greenough, to use the 70% value ratio for the adjustments.
Brett Blessing, Highway Foreman, met with the board and presented fuel quotes as follows, noting that there was a typo on the agenda stating that Nelson’s bid was $2.54/gallon, not $1.54/gallon:

Motion made by Russell, seconded by Greenough, to accept the low bid from MG Oil for $2.45835 per gallon for 8,000 gallons of gasoline, for a total amount of $19,666.80.
Motion made by Greenough, seconded by Russell, to accept the low and only bid from MG Oil at $2.8502 per gallon, for 8,000 gallons of 50/50 blend diesel, for a total amount of $22,801.60.
The Board discussed with Blessing and Seiler regarding the rates for a private road contract, commenting that the amount charged seemed too low. Blessing noted that the equipment only had to travel ¼ mile to provide the service. It was noted that there should be an increase on the amount charged for private road contracts and will need a motion for the increase in January of 2022.
Motion made by Greenough, seconded by Russell, to approve the 2021 year end reimbursement to the highway department for fuel used or work performed as follows: Sheriff’s Department for $2,224.09; Weed and Pest Office for $85.07; Emergency Management for $61.94; Election for $29.18; GIS for $42.12; Building for $86.78 and DOE for $64.97.
Discussion was held regarding the speed limits on County roads with the suggestion that there be more law enforcement presence on County roads, with Sheriff Evans noting that their main focus is centered around patrolling County roads and that there are only 5 individuals currently employed to patrol.
Discussion was held on the resignation of Joshua Robistow, Highway Administrative Assistant, effective January 14, 2022. Blessing noted that Ken Martin is willing to stay on to help train a successor. A motion to pay Ken Martin for his services and a motion to advertise if not filled by then will be on the January 6, 2022 agenda.

Discussion was held on the designation within the General Fund for bookkeeping purposes. Falkenburg noted that he did not want the surplus to go into the Building Fund. Greenough inquired if the money could possibly go into an Emergency Road Fund to be used for gravel or to hire contractors to assist with pulling up roads. Falkenburg recognized Susan Henderson who commented that there is a law enforcement crisis here and that maybe some of the surplus be designated to law enforcement. Greenough explained, if it was transferred into law enforcement’s budget for wages, that cash surplus would eventually run out and they would not be able to sustain that level.
Motion by Russell, seconded by Allen, to take the Estimated year end surplus in the amount of $216,000.00 out of the General Fund and designate it to a Supplemental Budget Fund.
Public comment was heard from Susan Henderson with concerns about law enforcement and costs, questioning the contract between the City of Hot Springs and Fall River County. Henderson also noted that the commercials are running on KCSR are working for Draft Bill 50 and Tax Remedy Resolution petitions. She would like the petitions to be circulated for as long as possible. She would also like to build a database of names. Falkenburg asked Trish Ladner when the petitions supporting Draft Bill 50 should be turned in, to which she stated February 1, 2022.
Trish Ladner, District 30 Representative, met with the Board to give an update on Draft Bill 50 for 2022 Legislation. Falkenburg noted that the Board wanted to express their appreciation for her involvement and support. There will be a town hall meeting Monday, January 3, 2022, 5 p.m. at the Buffalo Gap Community Center with supper provided, sponsored by the SD Stockgrowers Association. She and Senator Castleberry will be there presenting Draft Bill 50. A tour scheduled by the Stockgrowers Association of the Schroth Ranch near Buffalo Gap will also take place beginning at 2 p.m. A notice will be posted of a possible quorum of County Commissioners. She stated that she attended a similar meeting in Reva, SD, a town of 147 people. Over 100 area ranchers were in attendance. The KNBN news will be at the Schroth Ranch and town hall meeting to cover the presentations. A representative from Dusty Johnson’s office and two representatives from John Thune’s office were invited, along with other legislators and senators and were planning on attending. Falkenburg suggested that Ladner visit with Stacey Martin and Lillian Heidebrink about how the County is going to approach taxation of Ag land this coming year as the Commission is supporting their calculations. Ladner noted that the Bill is finalized and getting final approval from the LRC and that the sponsors are just about done gathering information on the fiscal impact study. A lot of public concern was raised on how this will impact things. They plan on dropping the Bill next week and start reaching out to the Senators and Representatives for their support, with a lot of support already noted. Falkenburg extended gratitude to Ladner again.
Motion made by Cope, seconded by Greenough to go into Executive Session as per SDCL 1-25-1 (1) for personnel purposes at 10:27 a.m.
The Board came out of Executive Session at 10:45 a.m.
Motion by Russell, second by Allen, to approve the $.75 raise to all employees effective December 21, 2021 that are out of the wage box as per Union Contract.
The Fall River and Oglala Lakota Contract will be presented at the January 6, 2022 meeting.
Discussion was also held on the need to increase wages within the County due to amounts offered throughout the area, noting that they would like to retain employees.
