Town of Oelrichs

The special meeting of the Town of Oelrichs was called to order at 1:32 p.m.
Allegiance to the flag was pledged.
Board Present: Joseph Messinio and Anita Cope
Board Excused: Mike Carson
STAFF PRESENT: Valarie Graf and Roy Merdanian III,
Staff Absent: Susan Hamilton and Doug Burdette
Guests Present: Town Attorney Lance Russell, Katie Merdanian, Ron Beseke, Jess Hamar, and Jennifer Her Many Horses
Comments and/or Concerns: Comments were made regarding:
-the perceived inadequacy of the Board alerting Oelrichs residents of meeting proceedings and actions. It was acknowledged by Board Lawyer that all state laws and requirements are constantly met regarding the posting of date, time, and location of each meeting, its agenda, and past month’s meeting minutes;
-the necessity for details surrounding the newly implemented 2% Sales Tax – how much will be received and where these funds will be allocated. The exact amount the Town will receive has not been determined since tax was first implemented in July; and
-the current lack of water pressure.
Approval of Agenda: J. Messinio made the motion to approve the August 23, 2021, Special Meeting Agenda, A. Cope seconded; motion carried.
Additions or Corrections to Agenda: None
Approval of Previous Special Meeting: J. Messinio made a motion to accept August 2, 2021, Special Meeting Minutes, A. Cope seconded; motion carried.
-1st Reading Chapter 7 – TABLED until Board approves purchase and receives a copy of the Universal Building Codes.
-2nd Reading Chapter 12 – Water Service – TABLED until such time all other ordinances are ready, for mass approval.
-2nd Reading Chapter 13 – Nuisances – TABLED until such time all other ordinances are ready, for mass approval.
-2nd Reading Chapter 15 – Fire Protection and Prevention – TABLED until Board approves purchase and receives a copy of the International Fire Codes, and J. Messinio is to meet with Oelrichs Volunteer Fire Chief to receive approval of Chapter 15 and the Oelrichs Fire Departments involvement in the content of the Chapter.
-Chapter 10 – Building Codes – TABLED until such time Board approves purchase and receives a copy of the Universal Building Codes.
-SD Municipal League Marijuana Ordinance Proposals – With assistance from Town Lawyer, a Notice of Public Hearing was sent to Fall River County Herald Star for publication of an Ordinance Amending Ordinance Chapter 17 and all Amendments, in accordance with the Provision of Chapter 9-19, 11-2 and 11-4, 1967 SDCL, and Amendments, and for the Repeal of all Resolutions and Ordinances in Conflict therewith.
End of Meeting Comments and Concerns (limit of 3 minutes per person): Concern was voiced regarding the contents of Town of Oelrichs proposed Chapter 13 – Nuisances. It was recommended that these concerns be brought to the next Town Board meeting.
Adjournment: J. Messinio made a motion to adjourn this Special Meeting at 3:22 p.m., seconded by A. Cope; motion carried.
The next Regular Meeting of the Oelrichs Town Board will be September 7, 2021, at 7:00 p.m. at the Oelrichs Community Center.
