Fall River County Unapproved Minutes of October 6, 2020
The Fall River Board of County Commissioners met in regular session on October 6, 2020. Present: Joe Falkenburg, Heath Greenough, Paul Nabholz, Deb Russell and Sue Ganje, Auditor. Joe Allen was absent. Falkenburg asked for a prayer for our country during this time.
The Pledge of Allegiance was given, and the meeting called to order at 9:00 a.m.
Joe Allen entered the meeting.
The agenda was reviewed for conflicts, none noted. All motions recorded in these minutes were passed by unanimous vote, unless otherwise stated. Motion made by Allen, seconded by Russell, to approve the agenda as written.
Chairman Falkenburg announced that Deb Russell was elected as the new President of the SD Association of County Commissioners at the recent convention in Sioux Falls, and will be an excellent representative for the entire state. He is proud to declare today as Deb Russell Day.
Commissioner Russell presented the platinum and gold 2020 Loss Control/Safety Achievement Awards to employees on behalf of the SD Public Assurance Alliance and the SDML Workers’ Compensation fund she accepted at convention. Russell have a brief report of the sessions she attended at convention including public comment policy, bridge grants, soil survey changes, townships and secondary roads, and mental health guidelines. Mental Health has guidelines to be followed, and Russell spoke of convention highlights.
The minutes of September 16, 2020 were not presented.
Motion made by Nabholz, seconded by Greenough, to surplus to junk an ASUS Pro Computer Windows 8, #01943 and Dell Windows 7 Computer, #01918, and surplus to sell Plantronics Headset (2), #01855 and #01856, all from the Register of Deeds office.
Motion made by Nabholz, seconded by Allen, to approve the Contract for Health Care Services with Fall River Health Services for inmates and victims of crimes, and authorize the chairman to sign.
Motion made by Greenough, seconded by Russell, to approve hiring Jean Johnson, greeter, at $11.00 per hour. With Nabholz voting no, all others voting yes, motion carries.
Motion made by Russell, seconded by Greenough, to approve the temporary part-time reclassification of Jon Lovett, from the highway department to GIS, 911 signs.
No county assistance or death expense applications were brought before the board.
Bob Evans, Sheriff, met with the board. Motion made by Allen, seconded by Greenough, to approve the temporary full-time re-classification of Elizabeth Rakness from deputy sheriff to dispatch at her existing wage rate.
Evans reported that there are 17 males and 5 females in Fall River County and 4 males and 1 female in Pennington County, for a total of 27 inmates.
Frank Maynard, Emergency Management, met with the board on Battle Mountain Road. After discussion, motion was made by Allen, seconded by Russell, to approve Steve Simunek to complete the portion of Battle Mountain Road that is not under contract, with a maximum of $11,000.00. With Nabholz voting no, all others voting yes, motion carries.
Maynard also reported on fires and incidents and that the Corps of Engineers were lowering the level of water at Coldbrook.
Teresa Pullen, Treasurer, met with the board. Motion made by Russell, seconded by Nabholz, to stop all new Real Estate Tax Payment Plans, while honoring the individuals that are staying current with their existing plan. By roll call vote, the motion carried.
Motion made by Nabholz, seconded by Russell, to add Liberty National Bank of Sioux Falls to portfolio for Certificates of Deposit.
Pullen will be bringing back information on a tax deed sale to the next meeting.
Lyle Jensen, Building Supervisor, met with the board. Motion made by Greenough, seconded by Allen, to approve payment for the Hydraulic Solutions LLC invoice for elevator service work, in the amount of $1,384.50.
Dan Cullen, Veteran’s Service Officer, met with the board. Motion made by Greenough, seconded by Allen, to approve travel for SDDVA VSO Standard meeting in Sioux Falls, SD, October 19 and October 20, 2020, in the amount of $262.27.
Cullen gave a brief 3rd quarter report, which business has been slower due to Covid-19. The convention in August was good, a meeting was held with the small business administration Veteran Business Development Office, met with clients, filed claims and $404,740 of disability or pension awards this quarter.
The supplement and contingency hearing was held as advertised. Motion made by Nabholz, seconded by Greenough, to approve the following resolution:

Contingency Transfers 2020, #3
WHEREAS, SDCL 7-21-32.2 provides that the Board of County Commissioners may adopt a transfer appropriation from the contingency budget to other appropriations, which are insufficient, a contingency transfer shall be approved and adopted to the following Department: Mental Illness Board 10100X4221445, $1,048.52
NOW THEREFORE BE IT RESOLVED by the Board of County Commissioners to adopt the Contingency Transfer #3 for 2020.

Randy Seiler, Highway Superintendent, met with the board. Motion made by Russell, seconded by Greenough, to approve the Golden West Telecommunications application for permit to occupy county highway right-of-way from an existing vault near 13321 N. Angostura Rd. to the northeast corner of the intersection of N. Angostura Rd. and Twin Rock Bend Rd.
Seiler updated the board that they put a 4’culvert in on Dewey Road.
Motion made by Greenough, seconded by Allen, to approve hiring Brosz Engineering to do inspections on bridges under 20 feet. With Nabholz voting no, all others voting yes, motion carries.
Sealed bids for asphalt millings were opened as advertised. Motion made by Greenough, seconded by Allen, to approve the only bid from Simon Contracting for asphalt millings at 14,000 ton quantity, stockpiled within 5 miles of Hot Springs in the Maverick Junction pit, at $8.25 per ton, for a total amount of $115,500.00.
Seiler updated the board with maps, with primary roads and secondary roads highlighted; he’d like the commissioners to take a tour at some point before or after the next meeting. Discussion was held on roads with washboards.

Public comment was heard from Commissioner Greenough about the increased amount of new people coming to our area and the effects on the courthouse and infrastructure; Commissioner Falkenburg would like to put a plaque on Fall River Road in recognition and remembrance of Roger Klein, the can man.

Commissioner Nabholz met with the board to discuss the Custer/Fall River Landfill and ability to handle waste from an emergency operation, with the example of ten homes being demolished in a flood. The CFR Landfill would and could accept about two years’ worth of rubble or MSW in a few weeks as preparations for new cells are usually planned for a couple years in advance. The rubble from ten homes would not be a large amount of waste to handle.
Bond documents were reviewed and discussed by the board and David D. Grossklaus, Attorney, via phone. Motion made by Greenough, seconded by Allen, to approve the engagement letter for the Bond Council Services. With Nabholz voting no, all others voting yes, motion carried.
The first reading of the Ordinance #2020-01, Bond Ordinance providing for the issuance and sale of economic development refunding revenue bonds, to provide funds for the refinancing of an economic development project on behalf of Fall River Health Services, a South Dakota Nonprofit Corporation, was heard. With Nabholz voting no, all others voting yes, by roll call vote, motion carries.
Motion made by Greenough, seconded by Allen, to set a hearing for Exhibit A, Notice of Intention to Issue Revenue Bords or Notes (Fall River Health Services Project), for the 2nd Reading of Ordinance – 2020-01, on October 20, 2020.
The 2020-09 Covid-19 resolution was reviewed. Motion made by Allen, seconded by Greenough, to leave the courthouse as it is. With Nabholz voting no, all others voting yes, by roll call vote, motion carries.
Discussion was held on the county owned lot in the Hot Brook Road District, liability to the county and the possibility of a tax deed sale. More will be discussed at the next meeting.
Falkenburg recognized the petitions received by people that live on Shep’s Canyon Road, that are being sent to SD Game Fish and Parks in reference to unsafe road conditions.
Motion made by Nabholz, seconded by Russell, to enter executive session as per SDCL 1-25-2 (1), SDCL 1-25-2 (3) and SDCL 1-25-4 for personnel, legal and negotiation purposes at 11:05 a.m.
The Board came out of executive session at 11:19 a.m.
