A Judgment and Decree of Foreclosure, having been filed on March 06, 2020, by the Circuit Court for the Seventh Judicial Circuit, Fall River County, in the action entitled U.S. Bank National Association, not in its individual capacity but solely as trustee for the RMAC Trust, Series 2018 G-CTT v. Terry N. Tice, et al, Civ. 23CIV19-000047, which Judgment and Decree of foreclosure in part directed a foreclosure sale of the following described real property in Fall River County, South Dakota:
THE EAST 16 FEET OF LOT 3 AND THE WEST HALF (W 1/2) OF LOT 4, BLOCK 2, CAMPUS ADDITION TO THE TOWN, NOW CITY, OF EDGEMONT, FALL FIVER COUNTY, SOUTH DAKOTA.
(aka 905 E St, Edgemont, SD 57735)
Together with all improvements, easements, rights and appurtenances on or accruing to such property;
NOTICE IS HEREBY GIVEN that for the purpose of realizing the sum of $64,514.17 as of March 06, 2020, plus interest accruing thereafter on said amount at the rate of 4.250% per year together with the costs and expenses of sale, will be sold subject to redemption as provided by law as one parcel of land at public auction subject to the lien for unpaid real estate taxes and assessments of Fall River County, South Dakota, and easements and restrictions of record, to the highest bidder for cash, by the Sheriff of Fall River County, at the front door of the Fall River County Courthouse in Hot Springs, South Dakota at the hour of 10:30 AM MT on May 21, 2020. Such property is that described in a Promissory Note and Mortgage dated January 24, 2017, recorded January 26, 2017 in Document No. R 05515; Book 25K of Mortgages, Page 697-710; which mortgage was assigned to Gateway Mortgage Group, LLC by Assignment of Mortgage recorded May 23, 2019 in Document # R 058600Book 35 M Page 430, executed by Terry N Tice an unmarried man.
If the sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of the deposit paid. The purchaser shall have no further recourse against the Mortgagor or the Mortgagee’s attorney.
