Fall River County Unapproved Minutes of February 4, 2020
The Fall River Board of County Commissioners met in regular session on February 4, 2020. Present: Joe Allen, Joe Falkenburg, Heath Greenough, Paul Nabholz, Deb Russell and Sue Ganje, Auditor.
The Pledge of Allegiance was given, and the meeting called to order at 9:00 a.m.
The agenda was reviewed for conflicts; none were noted. All motions recorded in these minutes were passed by unanimous vote, unless otherwise stated. Motion made by Greenough, seconded by Russell, to approve the agenda as written.
Motion made by Nabholz, seconded by Greenough, to approve the minutes of January 21, 2020.
Motion made by Russell, seconded by Allen, to approve reinstating Micheal DeBoer, jailer, as full time, $15.50 per hour, effective January 22, 2020, as per union contract.
Motion made by Nabholz, seconded by Russell, to approve the pay raise for Austin Zimiga, jailer, to $15.50 per hour, effective December 21, 2019, as per union contract.
Motion made by Allen, seconded by Greenough, to approve the pay raise for Carol Boche, State’s Attorney’s office, to $15.00 per hour, to reflect new classification, effective December 21, 2019, as per union contract.
Motion made by Russell, seconded by Nabholz, to approve the purchase of 3 new computers from Golden West, for the Auditor’s Office, in the estimated amount of $789.00 each.
Motion made by Nabholz, seconded by Greenough, to approve a letter to Dave Pfeifle, SDPAA, to express appreciation for the recent training, and authorize the chairman to sign.
Motion made by Allen, seconded by Nabholz, to approve the Chairman to sign the following tax deed transfers to the City of Edgemont:
Lot Eight (8) in Block One Hundred Thirty-four (134) First Addition to the town, now City, of Edgemont, Fall River County, State of South Dakota;
Lots Seventeen (17), Eighteen (18), Nineteen (19) and Twenty (20) in Block 52 of First Addition to the Town, now City, of Edgemont, Fall River County, South Dakota;
The South 79.3’ of Outlot “E” Located in the SE1/4 of the NW1/4 of Section 1, Township 9, South of Range 2, East of the Black Hills Meridian, Fall River County, South Dakota;

Motion made by Greenough, seconded by Nabholz, to approve travel for Bobbie Janis and Stacy Schmidt, Auditor’s Office, for election equipment training in Deadwood, SD on February 18, 2020.
Motion made by Russell, seconded by Greenough, to approve Fall River County Commissioner’s signatures on the December 21, 2019 – December 20, 2022 Collective Bargaining agreement. With Nabholz voting no, all others voting yes, motion carries.
No applications for county assistance or death expenses were presented to the board.
Frank Maynard, Emergency Management, met with the board to advise of a meeting with state OEM officials on potential spring flooding, with Maynard noting that his concern was more for fire danger. Updates were given on the LEOP, which is now complete, and authorization to adopt the plan was requested. Motion made by Greenough, seconded by Russell, to approve the updated Local Emergency Operation Plan, Certificate of Adoption, and authorize the chairman to sign.
Maynard noted his attendance to the AWR-147 Rail Car Incident Response training in Rapid City. Motion made by Nabholz, seconded by Allen, to approve travel for Maynard to attend the Substantial Damage 101 Course in Spearfish on February 11, 2020 and the FEMA Individual Assistance Training in Rapid City on February 18, 2020.
Maynard updated the board on the Pre-Disaster Mitigation Plan (PDM), which included discussion on the need to include the removal of fuels in Buffalo Gap National Grassland (BHNG) grazing leases. Fires and incidents were also reported.
Stacey Martin, GIS Director, met with the board to discuss new 911 addresses in the county, noting that not as many homes have been completed the past year, in comparison to prior years. Also discussed were participation in census projects, additional PILT acreage and the combining of tax parcels and tax districts.
Martin discussed that there is an average of 48 viewers on the meeting videos, but no comments have been made since the policy was put into effect a year ago. Motion made by Nabholz, seconded by Allen, to approve removing the option to be able to comment on commission meeting videos at YouTube.com.
Discussion was held on usage (7 incidents) of CodeRed in 2019, and the proper way to notify the public if the courthouse was closed to inclement weather, or national security situations. The board felt that notifications given between 7:00 a.m. to 9:00 p.m. were appropriate for the general public.
Motion made by Allen, seconded by Greenough, to approve travel for Stacey Martin, Bobbie Janis and Melissa Fleming to attend PIO (Public Information Officer, and assistants) training on Social Media Engagement Strategies, in Rapid City, on March 4, 2020.
Motion made by Nabholz, seconded by Allen, to approve the increased sign replacement quote from Newman signs in the amount of $2,822.80.
Brief discussion was held on the possibility of selling old 911 road signs, no action taken.
Heath Greenough and Vince Logue, Oelrichs Historical Society, requested the transfer of the tax deed property to the historical society. Motion made Allen, seconded by Nabholz, to approve transferring the tax deed property acquired in 2019, legal description of Original Town of Oelrichs: Lot 2, Block 33, to the Oelrichs Historical Society.
Paul Nabholz, Commissioner, spoke on SB 51 (authorizes the possession of a concealed pistol by employees in county courthouses) which passed with amendments, and asked for commission support on the senate bill. Motion made by Nabholz, seconded by Greenough, to support SB51 that will allow county employees to carry. With Allen and Russell voting no, all others voting yes, by roll call vote, motion carries.
Discussion was held on SB 58 (limit gifts to directors or employees of certain government districts). This died in the Senate Local Government committee. Discussion was also held on the lookout solar project in Oglala Lakota and Custer Counties, noting that he voted yes for the facility.
Dustin Ross, Andersen Engineers, met with the board. Motion made by Russell, seconded by Greenough, to approve the following plat:
Fall River County Resolution #2020-07
A plat of Paradise Tract of Govt. Lot 2 of Section 3, T9S, R3E, BHM, Fall River County, South Dakota
WHEREAS, there has been presented to the County Commissioners of Fall River County, South Dakota, the within plat of the above described lands, and it appearing to this Board that the system of streets conforms to the system of streets of existing plats and section lines of the county; adequate provision is made for access to adjacent unplatted lands by public dedication or section line when physically accessible; all provisions of the county subdivision regulations have been complied with; all taxes and special assessments upon the property have been fully paid; and the plat and survey have been lawfully executed; now and therefore,
BE IT RESOLVED that said plat is hereby approved in all respects.

Lyle Jensen, Hot Springs Fire Department, met with the board. Costs from Atlas Outfitters were reviewed for equipment needed. Motion made by Nabholz to support the purchase of 1 or 2 Stearns Rapid Rescue Extreme Drysuits at $635.00 each. Motion dies for a lack of the second. The board asks that other entities be contacted to help with costs.

Public comment was heard from Sheriff Evans noting that there are 19 males and 6 females in the Fall River County jail, with 1 male and 2 females in the Pennington County Jail.
Randy Seiler, Highway Superintendent, met with the board. Fuel quotes were presented as follows:
1/28/2020 Fuel Quotes: 5,000 Gal E10 87 Gasoline
Nelson’s: No Bid
M.G. Oil: $1.98/gallon
Hi-D-Way Oil: No Bid
Motion made by Russell, seconded by Greenough, to approve the only bid from M.G. Oil for 5,000 gallons of E10 87 gasoline, at $1.98 per gallon, for a total amount of $9,900.00.
Seiler notified the board of the MSHA meeting on February 19, 2020 in Hot Springs that all employees will attend. Discussion was held on the purchase of a building to house a road grader in Oral - Seiler will bring back to the next meeting as the price will be more than originally expected.
Motion made by Russell, seconded by Greenough, to approve travel for Seiler to attend the Short Course in Deadwood, on March 25 and March 26, 2020.
Seiler updated the board about a meeting in Rapid City to discuss the Chilson Bridge. Plans are continuing, with bid letting in the Fall of 2020, with building the project in the Winter of 2021. Game, Fish and Parks will close the trail from October through May. Discussion was held on snow removal along with some complaints of blading and graveling various roads.
Motion made by Greenough, seconded by Russell, to enter executive session, as per SDCL 1-25-2(1) for personnel purposes, at 10:26 a.m.
The board came out of executive session at 10:30 a.m.
