Judgment in the amount of $119,023.81 having been entered in favor of plaintiff and against defendants, which Judgment was filed with the Clerk of Courts of Fall River County, South Dakota, on November 22, 2019, for the foreclosure of a real estate mortgage,
Notice is hereby given pursuant to said Judgment that the real property described in the Mortgage dated January 3, 2008, which Pamela A. Murry, Mortgagors, executed and delivered to Wells Fargo Financial South Dakota, Mortgagee:
Lot Eighteen B (18B), Nineteen (19), Twenty (20), Twenty-One (21) and Twenty-Two (22) in Block Twenty-Four (24), Mammoth Springs addition to town, now city of Hot Springs, Fall River County, South Dakota, according to the plat thereof recorded in Book XII of plats, Page 54, in the office of The Fall River County Register of Deeds
and recorded in the office of the Register of Deeds of Fall River County, South Dakota, on January 16, 2008, as Book 9J, Page 388,. Said mortgage has been assigned to US Bank Trust National Association, as Trustee for Bluewater Investment Trust 2017-1 by Assignment of Mortgage recorded on August 22, 2018, as Book 31K of Mortgages, Page 746, Said mortgage has been assigned to MTGLQ Investors, L.P. by Assignment of Mortgage recorded on March 25, 2019, as Book 35K of Mortgages, Page 1,, in order to realize the amount of $111,809.03 as of January 3, 2008 plus interest accruing thereafter on said amount at the current rate of 5.75000% per year , together with the costs and expenses of sale, will be sold subject to redemption as provided by law as one parcel of land at public auction, subject to the lien for unpaid real estate taxes and assessments of Fall River County, South Dakota, and easements and restrictions of record, to the highest bidder for cash under the direction of the Sheriff of Fall River County, South Dakota, at the front door of the Fall River County Courthouse, in Hot Springs, South Dakota, on January 23, 2020 at 10:30 AM (MT).
If the sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of the deposit paid. The Purchaser shall have no further recourse against the Mortgagor, the Mortgagee or the Mortgagee’s attorney.
