Regular Meeting
December 17, 2019
Call To Order – Roll Call: Mayor Jerry Dibble called the regular meeting of the Edgemont Common Council to order at 7:00 p.m. on December 17, 2019, at Edgemont City Hall. Present were Council members, Roger Horton, Carla Schepler, Jason Shook and John Sturgis. Kimberly McDade and Robert Worden were absent.
The Pledge of Allegiance was stated.
Conflict Of Interest For Council Members: No conflicts were heard.
Approval Of Agenda: Jason Shook made a motion to approve the December 17, 2019 agenda. Motion seconded by Roger Horton. Motion passed with unanimous vote.
Approval Of Minutes: Carla Schepler made a motion to approve the December 3, 2019 minutes. Motion was seconded by John Sturgis. Motion passed with unanimous vote.
Committee Reports:
Law Enforcement – No officer present
Public Works – Roger Horton
Mayor – Mayor Dibble discussed the County Commissioners meeting and that they are giving the City the property taken due to past taxes. Discussed with AE2S concerns over water treatment facility and they will have a meeting after the first of the year to work on the issues we have been having.
Public Comment: Andrea Powers, from SHEDCO, discussed the BBB grant with the property the City just received from the County for back taxes along with all of the options. The Council will look things over and will have it on the next agenda.
Approval Of Claims: Carla Schepler made a motion to approve the December 17, 2019 claims totaling $51,173.90. Motion seconded by John Sturgis. Motion carried with unanimous roll call vote.

Resolution 2019-12-17-1 – Annexation For Dollar General Public Hearing: Mayor Dibble opened the hearing for the annexation of the Dollar General property. No public comments or concerns were heard. Mayor Dibble closed the public hearing.
 Carla Schepler made a motion to approve the Resolution to annex the Dollar General as read and to have the Mayor sign. Motion seconded by Jason Shook. Motion carried with unanimous roll call vote.

Resolution Of Annexation Of Contigous Territory Into
The City Of Edgemont
WHEREAS, Edgemont 20746, LLC, an Oklahoma Limited Liability Company, of P.O. Box 35366, Tulsa, OK 74153, by and through Mark D. Helmer, President of MCBJ Enterprises, Inc., Manager of Edgemont 20746, LLC, filed a Petition requesting that the Edgemont Dollar General Tract be annexed to the City of Edgemont, Fall River County, South Dakota by Resolution of the Edgemont City Council pursuant to SDCL 9-4-1;
WHEREAS, the Edgemont City Council has determined that it is in the best interests of the City to annex the Petitioner’s Edgemont Dollar General Tract, which is contiguous to the City of Edgemont with the following legal description:
Plat of Edgemont Dollar General Tract (formerly part of Prairie Acres Estates), located in the SW1/4SW1/4 of Section 36, Township 8 South, Range 2 East of the Black Hills Meridian, Fall River County, South Dakota, as Shown on Plat Filed in Book XXVII of Plats, Page 157, in the Office of Register of Deeds, Fall River County, South Dakota.
which territory is the Edgemont Dollar General Tract.
WHEREAS, the territory is already developed and being utilized by Edgemont 20746, LLC as a business, and ample and suitable resources exist to accommodate the orderly growth or development of the contiguous territory;
WHEREAS, there are no residents in the contiguous territory, and as such, no individual will be burdened with a difference in tax assessment rate in the contiguous territory;
WHEREAS, the exclusions and irregularities in boundary lines are not the result of arbitrariness;
WHEREAS, there is a reasonable and demonstrable future need for annexing the contiguous territory for the orderly development of the Petitioner’s property and the orderly growth of the City of Edgemont; and
WHEREAS, population, development and census data and evidence indicate that the municipality has or may experience growth or development beyond its present boundaries making the City of Edgemont and Petitioner’s property easier to do business and encourage future growth and stability.
NOW THEREFORE, BE IT RESOLVED that the City of Edgemont, pursuant to SDCL 9-4-1, hereby annexes the contiguous territory with the legal description of:
Plat of Edgemont Dollar General Tract (formerly part of Prairie Acres Estates), located in the SW1/4SW1/4 of Section 36, Township 8 South, Range 2 East of the Black Hills Meridian, Fall River County, South Dakota, as Shown on Plat Filed in Book XXVII of Plats, Page 157, in the Office of Register of Deeds, Fall River County, South Dakota.

Resolution 2019-12-17-2 – Supplemental Budget: Carla Schepler made a motion to approve the Supplemental Budget Resolution 2019-12-17-2 as read. Motion seconded by Jason Shook. Motion carried with unanimous roll call vote.

WHEREAS the budgeted monies for various general fund departments will not be adequate to cover the expenses of the 2019 fiscal year, and
WHEREAS the following funds can be transferred from the General Fund Contingency to the following departments to cover the expenses for the 2019 fiscal year:              
Total to be Transferred: $0.00
THEREFORE BE IT HEREBY RESOLVED by the Mayor and Common Council, that $0.00 be transferred from the General Fund Contingency to the above listed departments in the listed amounts to cover expenses incurred in 2019.
WHEREAS the additional State funds were received for West Nile Virus Prevention and Fire Dept.
THEREFORE the following funds are supplemented:
334.1 State Loan/Grants - (income) - $21,632.00
422 Fire Department - (expense) - $21,632.00
334.1 State Grants - (income) - $2,223.00
441.3 West Nile - (expense) - $2,223.00
Total to be Transferred: $23,855.00
THEREFORE BE IT HEREBY RESOLVED by the Mayor and Common Council, that $23,855.00 be supplemented into 2019 budget.

Executive Session Per Sdcl 1-25-2 (1,3 & 4) Personnel/Litigation/Contracts: Carla Schepler made a motion to enter into Executive Session at 7:35 p.m. Motion was seconded by Roger Horton. Motion passed with unanimous vote.
Returned to Regular Meeting at 8:02 p.m.
No action was taken.
Adjournment: Jason Shook made a motion to adjourn at 8:03 p.m. Motion was seconded by John Sturgis. Motion carried with unanimous vote.
The next regular City Council meeting will be held January 7, 2020 at 7:00p.m.
